1. Descriere
    1. Prezentul Regulament se aplică pentru evenimentele organizate de INFLUX EVENTS S.R.L., denumit în continuare Organizator și definește regulile pe care fiecare participant la eveniment trebuie să le respecte, precum și drepturile și obligațiile Organizatorului și ale Participantului.
    2. Prezentul Regulament este o înțelegere între Organizator și Participant. Respectarea acestui Regulament este obligatorie pentru toate persoanele prezente la evenimente, iar în cazul nerespectării acestuia, Organizatorul își rezervă dreptul de a refuza intrarea persoanelor în cauză în locația evenimentului sau excluderea de la eveniment, caz în care contravaloarea taxei de participare nu se restituie. De asemenea, prezentul Regulament se aplică oricăror alți invitați, voluntari sau orice alte persoane participante, indiferent de calitatea acestora, la Evenimente.
    3. Organizatorul își rezervă dreptul de a modifica acest Regulament atunci când se impune, iar orice modificare va fi afișată în descrierea evenimentului care va fi comunicată și transmisă Participanților de către Organizator.
    4. Prin achitarea taxei de participare la Evenimente, Participantul se obligă să respecte acest Regulament.

 

  1. Tipul de eveniment, perioada și locul de desfășurare
    1. Evenimentul se desfășoară în spațiul special delimitat în acest scop de Organizator.
    2. Evenimentul constă în activități dedicate învățământului în domeniul cultural (muzică, teatru, dans, arte etc.), altor forme de învățământ, activităților de interpretare artistică (spectacole), activităților suport pentru interpretarea artistică (spectacole) și alte activități recreative și distractive.
    3. Evenimentul se va desfășura la datele și intervalele orare aduse la cunoștință de către Organizator, în conformitate cu prevederile prezentului Regulament.
    4. Programul de desfășurare a evenimentelor se va aduce la cunoștință de către Organizator în funcție de topicul specific.
    5. În situația în care Organizatorul decide să modifice / scurteze / prelungească perioada de desfășurare, durata și / sau programul Evenimentului, acest fapt va fi adus la cunoștință publică în modalitatea prevăzută la art. 1.3.

 

  1. Taxa de participare, Acces, Participare
    1. Accesul la eveniment se face în baza dovezii de achitare a taxei de participare.
    2. Dovada achitării în baza căreia se va face accesul trebuie păstrată pe toată durata evenimentului.
    3. Documentul de plată este valabil pentru o singură persoană.
    4. Accesul în locația evenimentului se face înainte de începerea evenimentului conform informațiilor furnizate în prealabil de către Organizator.
    5. Taxa de participare poate fi achitată doar fizic la sediul Organizatorului.
    6. Este strict interzisă publicarea, sub orice formă, pe rețele sociale sau în alte medii online a documentului privind achitarea taxei de participare, precum și revânzarea acestuia. Dovezile de plată nu pot fi înlocuite, iar contravaloarea lor nu poate fi restituită, în cazul culpei excusive a Participantului.
    7. Accesul minorilor (0-18 ani) în locația evenimentului este interzisă.
    8. Este interzis:
      1. accesul cu arme sau orice alte obiecte ce pot fi considerate periculoase, arme albe sau alte obiecte ce pot produce un pericol public;
      2. accesul cu recipiente de sticlă, materiale inflamabile, pixuri cu laser;
      3. accesul cu animale, cu excepția celor care însoțesc persoanele cu dizabilități;
      4. accesul cu alcool sau substanțe psihoactive;
      5. comercializarea de produse în zonele evenimentului fără acordul organizatorului;
      6. consumul sau comercializarea de substanțe interzise;
      7. consumul sau comercializarea de bauturi alcoolice, altele decât cele comercializate de Organizator.
    9. Este STRICT INTERZIS accesul și utilizarea în perimetrul evenimentului fără autorizația organizatorului pentru echipamente de înregistrare audio-video, inclusiv, dar nelimitat la camere video profesionale și semi-profesionale, inclusiv pentru camere foto ce dețin obiectiv detașabil sau telefoane mobile. Posesorii unor astfel de echipamente sunt obligați să se supună predării acestora în custodie temporară.
    10. Pe durata evenimentului, Organizatorul sau partenerii Organizatorului pot realiza înregistrări audio și video în care pot fi cuprinse imagini și voci ale invitaților prezenți la eveniment, dar și ale Participanților.
    11. Persoanele care apar în filmările/fotografiile realizate își expirmă acordul față de Organizator sau parteneri pentru realizarea filmărilor/fotografiilor, completând și semnând în acest sens declarația pe proprie răspundere de acceptare a utilizării datelor cu caracter personal, inclusiv a imaginii proprii.
    12. Organizatorul sau partenerii Organizatorului se obligă să realizeze filmările sau fotografiile doar în scopul documentării evenimentelor realizate de aceștia;
    13. Orice material foto/video, efectuat în timpul Evenimentului, va putea fi utilizat în scopul promovării sau publicității evenimentelor viitoare, doar cu acordul expres al persoanelor surprinse în aceste materiale, în condițiile Acordului de Prelucrare a Datelor cu Caracter Personal și al declarației pe proprie răspundere, pe care aceștia le vor semna.
    14. De asemenea, locația în care se desfășoară Evenimentele și perimetrul acesteia sunt monitorizate video în scopul supravegherii bunurilor și asigurării siguranței persoanelor.

 

  1. Reguli de conduită în cadrul Evenimentelor
    1. Pentru o bună desfășurare a evenimentului persoanele care ajung după începerea acestuia vor avea acces în locație doar în timpul pauzelor programate, în limita locurilor rămase libere. După ce numărul maxim de participanți este atins, nu mai este permisă intrarea niciunei alte persoane, indiferent de momentul în care a sosit.
    2. Participanții trebuie să evite conflictele și să se respecte reciproc.
    3. Nuditatea și orice acțiuni care pot fi considerate ofensatoare sau contrare bunelor moravuri nu sunt permise și nu sunt încurajate în timpul desfășurării Evenimentului.
    4. Toți participanții trebuie să respecte regulile sociale, legile și cele enumerate în acest Regulament.
    5. Toți participanții sunt așteptați să se comporte cu respect față de ceilalți, să evite gesturile sau acțiunile ofensatoare și să se abțină de la comportamente care ar putea deranja sau incomoda alte persoane.
    6. Participanții sunt rugați să poarte îmbrăcăminte corespunzătoare și să mențină un nivel adecvat de acoperire corporală pe toată durata evenimentului.
    7. Hărțuirea, intimidarea sau agresiunea fizică sau verbală a altor participanți sau a personalului evenimentului nu va fi tolerată și poate duce la excluderea imediată din cadrul evenimentului.
    8. Folosirea limbajului obscen sau a gesturilor nepotrivite este strict interzisă. Toți participanții trebuie să se exprime într-un mod civilizat și să evite orice formă de violență verbală sau fizică.
    9. Fiecare participant este responsabil pentru propriile acțiuni și comportament și va fi supus consecințelor legale sau disciplinare în cazul nerespectării acestui Regulament.
    10. Participanților le este interzis să desfășoare orice fel de activități care ar putea să pună în pericol sau să afecteze în orice mod siguranța sau drepturile celorlalți participanți.
    11. Orice interacțiune fizică între participanți trebuie să fie bazată pe un consimțământ explicit, clar și neechivoc. Fiecare participant trebuie să fie conștient de limitele celuilalt și să le respecte în totalitate. Orice presiune sau insistență pentru a depăși aceste limite este inacceptabilă.
    12. Orice persoană are dreptul de a-și retrage consimțământul în orice moment al interacțiunii fizice. Dacă una dintre părți se simte inconfortabilă sau dorește să oprească activitatea, aceasta trebuie respectată fără întrebări sau presiune.
    13. Consimțământul ar trebui să fie obținut pentru fiecare etapă sau progresie a interacțiunii fizice. Aprobarea pentru o anumită acțiune nu implică automat aprobarea pentru alte acțiuni.
    14. Organizatorul nu își asumă răspunderea pentru eventualele prejudicii (materiale sau fizice) cauzate prin nerespectarea Regulamentului și va putea solicita despăgubiri persoanelor vinovate de încălcarea acestuia.
    15. Participanții sunt obligați ca, în incinta locului de desfășurare a evenimentului, să respecte și să nu distrugă mediul înconjurător, incluzând construcțiile și dotările.
    16. Toți Participanții sunt obligați să nu desfășoare niciun fel de acțiuni care să pună în pericol viată sau integritatea corporală a celorlalte persoane participante la Eveniment și își asumă întreaga responsabilitate pentru eventualele accidente sau orice prejudicii ce vor rezulta în urma acțiunilor lor.
    17. Consumul de droguri sau alte substanțe interzise este ilegal și strict interzis și va fi pedepsit conform legilor în vigoare. Este interzis accesul persoanelor care dețin asupra lor droguri, stupefiante, materiale sau substanțe toxice, explozive, inflamabile, iritant-lacrimogene sau alte substanțe/materiale considerate a fi periculoase de legislația în vigoare, precum și a persoanelor ce dețin asupra lor orice fel de armament, muniții, obiecte contondente.
    18. Se interzice accesul la eveniment a persoanelor aflate sub influența alcoolului sau a altor substanțe psihoactive.

 

  1. Sănătate și securitate. Situații de urgență
    1. Toți Participanții sunt obligați să respecte regulile privind protecția contra incendiilor și panicii în unitățile/locurile accesibile publicului (PSI/ISU) și în general să adopte toate masurile de protecție necesare sanitare, de securitate, de disciplină a muncii și în general a legislației în vigoare.
    2. Toți Participanții sunt obligați să acționeze pentru prevenirea producerii de incendii sau alte evenimente, să anunțe de îndată Organizatorul și organele competente asupra iminenței sau producerii unor astfel de evenimente, și să respecte legislația de prevenire a incendiilor.
    3. Toți Participanții sunt obligați să nu desfășoare niciun fel de acțiuni care să pună în pericol viața sau integritatea corporală a publicului și își asumă întreaga responsabilitate pentru eventualele accidente sau orice prejudicii ce vor rezulta în urma acțiunilor lor.

 

  1. Sancțiuni
    1. Organizatorul are dreptul, cu efect imediat, de a interzice accesul unui participant în incinta spațiului de desfășurare a evenimentului total sau parțial, sau de a invita participantul să părăsească incinta, în cazul încălcării prezentului Regulament sau a unei legi în vigoare din România, fără ca participantul să aibă dreptul la restituirea contravalorii taxei de participare.
    2. Participanții la Eveniment acceptă să se conformeze întocmai acestui Regulament, accesul acestora la Eveniment fiind permis doar în condițiile conformării la regulile incluse în prezentul Regulament, fără limitări sau rezerve.
    3. Participanții pot fi ținuți răspunzători pentru daunele directe sau indirecte cauzate locației, proprietarilor acesteia, Organizatorilor, angajaților, voluntarilor și colaboratorilor acestuia, precum și celorlalți Participanți/invitați la Eveniment.
    4. În situația în care, din motive obiective, Evenimentul nu mai poate fi desfășurat în condițiile prezentului regulament, Organizatorul își rezervă dreptul de a decide anularea acestuia, înainte de data la care Evenimentul trebuia să aibă loc, cu respectarea condițiilor de publicitate. În această situație, Organizatorul va comunica Participanților data la care Evenimentul va fi reprogramat, precum și posibilitatea utilizării taxei de participare achizitionată sau returnarea sumelor deja plătite, în cazul în care Participantul își exprimă, în mod expres, refuzul de participare. În orice situație, Organizatorul nu este ținut de plata vreunei sume de bani cu titlu de despăgubire sau daune.
    5. În situația în care, din motive obiective ori din cauza nerespectării prezentului Regulament de către Participanți, într-o manieră ce duce la imposibilitatea desfășurării Evenimentului în condiții normale, Organizatorul poate decide încheierea acestuia înainte de programul stabilit. În această situație, Organizatorul nu poate fi obligat la returnarea contravalorii taxei de participare sau la plata unor sume de bani cu titlu de despăgubire sau altele asemenea.
    6. Eventualele litigii apărute între Organizator, pe de o parte, și oricare dintre Participanți, pe de altă parte, se vor rezolva pe cale amiabilă sau, în cazul în care această cale nu va fi posibilă, litigiile vor fi soluționate de către instanța competentă de la sediul Organizatorului. Legea aplicabilă este legea română.

 

  1. Forța Majoră
    1. În cazurile de forță majoră cum ar fi situațiile de război, revoltă, atac terorist, demonstrații, embargo economic, accident, incendiu, dezastru natural, cutremur, inundație, scurtcircuit major, epidemii, rezoluții oficiale sau alte cazuri ce nu pot prevăzute sau nu pot fi controlate de Organizator sau de participant, Organizatorul nu este obligat să respecte obligațiile din prezentul Regulament. Organizatorul nu este răspunzător pentru prejudiciile suferite de participanți, dacă acestea sunt urmare a unui caz de forță majoră, ce poate fi dovedit prin documente eliberate de autoritățile competente.

 

  1. Prelucrarea datelor cu caracter personal
    1. Organizatorul prelucrează datele cu caracter personal ale participanților și însoțitorilor astfel:
      a) Categorii de date: nume, prenume, adresa de e-mail, număr de telefon; imaginea/înregistrări audio-video.
      b) Scopul prelucrării poate include: Executarea contractului și îndeplinirea unor obligații în domeniul protecției datelor cu caracter personal - Art. 6 alin. (1) lit. b din Regulamentul nr. 679/2016; Mediatizarea evenimentului, inclusiv pentru publicitatea ce va fi făcută pentru evenimente viitoare; Interesul legitim al Organizatorului –Art. 6 alin. (1) lit. f din Regulamentul nr. 679/2016.
    2. Participanții la Eveniment înțeleg că datele cu caracter personal constând în imaginea proprie și voce vor putea fi colectate astfel și prelucrate în scopul documentării și arhivării evenimentelor artistice. Prelucrarea înregistrărilor audio-video și a imaginilor se realizează în interesul legitim al Organizatorului, fiind avute în vedere și respectate drepturile și libertățile persoanelor vizate.
    3. Organizatorul are dreptul de a folosi aceste materiale, în scopul mediatizării evenimentului, dar și pentru publicitatea ce va fi facută pentru evenimentele viitoare, doar cu acordul expres al persoanelor surprinse în aceste materiale, în condițiile Acordului de Prelucrare a Datelor cu Caracter Personal și al declarației pe proprie răspundere, pe care aceștia le vor semna.
    4. După exprimarea acordului de prelucrare a datelor cu caracter personal în scopuri publicitare și a semnării declarației pe proprie răspundere, Organizatorul are dreptul de a folosi aceste materiale, inclusiv de a le publica pe diverse canale (ex. Facebook, YouTube, etc), fără a compensa în vreun fel participantul.
    5. Pe perioada evenimentelor, Organizatorul, partenerii asociați ai Organizatorului au dreptul de a înregistra și fotografia evenimentul. Participanții iau la cunoștință că există posibilitatea de a apărea în astfel de materiale, fără a putea emite pretenții asupra drepturilor cu privire la respectivele materiale.
    6. Participanții iau la cunoștință că, în incinta spațiului de desfășurare a evenimentului, este interzisă orice activitate comercială sau de publicitate fără acordul scris al Organizatorului.
    7. Datele participanților și însoțitorilor pot fi divulgate către parteneri ai Organizatorului, sponsori, operatori asociați ai Organizatorului, persoane împuternicite, furnizori externi de servicii (ex.: marketing, contabilitate), doar în acord cu exprimarea vointei participantului.
    8. Participanții au următoarele drepturi referitoare la protecția datelor: accesul la acestea, rectificarea sau ștergerea acestora sau restricționarea prelucrării, dreptul de a se opune prelucrării, dreptul la portabilitatea datelor și dreptul de a depune o plângere în fața unei autorități de supraveghere (Autoritatea Națională de Supraveghere și Protecție a Datelor cu Caracter Personal – A.N.S.P.D.C.P.).
    9. Prelucrarea acestor date nu se va face în niciun alt scop decât cel declarat în prezentul Regulament și exprimat de Participant. Organizatorul garantează că a implementat proceduri tehnice și organizatorice pentru protejarea acestor date și că prelucrarea se va face în mod legal, conform Regulamentului European nr. 679/2016 și legislației naționale aplicabile.

    1. Răspunderea
      1. Organizatorul nu este responsabil pentru bunurile participanților ori pentru eventualele pagube personale produse.
      2. Organizatorul exclude asumarea responsabilității pentru stricăciunile petrecute în spațiul de desfășurare a evenimentului, care nu au fost cauzate cu intenție de către acesta.
      3. Organizatorul nu este responsabil pentru comportamentul Participanților. Fiecare dintre participanți răspunde pentru orice prejudiciu creat unui alt participant, Organizatorului sau unei terțe persoane pe parcursul desfășurării evenimentului ori în legătură cu acesta.
      4. Se exclude răspunderea Organizatorului pentru daune indirecte, incluzând pierderi importante, daune imateriale, profituri pierdute, economii ratate și / sau daune cauzate de întreruperea afacerii.
      5. Organizatorul nu este responsabil pentru acțiunile ce se petrec în afara spațiului de desfășurare a evenimentului.

     

    1. Informații
      1. Organizatorul își rezervă dreptul de a efectua controale pentru a se putea asigura respectarea prezentului Regulament. Nu sunt tolerate excepții de la aceste reguli, încălcarea prezentului Regulament putând duce la evacuarea persoanei în cauza din spațiul de desfășurare a evenimentului și interzicerea accesului, fără rambursarea contravalorii taxei de participare.
      2. Persoanele care încalcă acest Regulament, inițiază sau participă la evenimente care tulbură ordinea, vor fi imediat escortate în afara perimetrului de desfășurare a Evenimentului, accesul lor va fi interzis la evenimentele viitoare, iar Organizatorul va anunța autoritățile abilitate ale statului, dacă va fi necesar.

     

    1. Sesizări
      1. Cererea scrisă, expresă și motivată, a Participanților la Eveniment, în vederea sesizării Organizatorului cu privire la orice nereguli constatate în desfășurarea Evenimentului sau orice nerespectări ale Regulamentului, poate fi depusă la următoarea adresă de e-mail influxeurope@gmail.com, însă nu mai târziu de ora 17:00 a primei zile lucrătoare după Eveniment.
      2. Orice sesizare depusă după trecerea termenului de mai sus nu va mai fi luată în considerare. În cuprinsul sesizării, participanții vor completa și datele de contact (i.e. adresa / email) unde răspunsul la sesizare trebuie expediat.
      3. Soluționarea sesizărilor se va efectua în termen de maximum 30 de zile lucrătoare de la depunerea acestora. Răspunsul la sesizare va fi comunicat de către Organizator, participantului, prin poșta sau email, la adresa indicată în sesizarea depusă.

     

    1. Condiții De Returnare A Taxei de Participare
      1. Returnarea taxei de participare și rambursarea contravalorii acesteia se face în condițiile existenței unei culpe exlusive a Organizatorului.

  1. Description
    1. These Regulations apply to events organized by INFLUX EVENTS SRL, hereinafter referred to as the Organizer , and define the rules that each event participant must follow, as well as the rights and obligations of the Organizer and the Participant .
    2. These Regulations are an agreement between the Organizer and the Participant. Compliance with these Regulations is mandatory for all persons present at the events, and in case of non-compliance, the Organizer reserves the right to refuse entry of the concerned persons to the location of the event or to exclude them from the event, in which case the participation fee will not be refunded. Also, these Regulations apply to any other guests, volunteers or any other persons participating, regardless of their quality, at the Events.
    3. The Organizer reserves the right to modify these Regulations when necessary, and any modification will be displayed in the description of the event that will be communicated and transmitted to the Participants by the Organizer.
    4. By paying the Event participation fee, the Participant undertakes to comply with these Regulations.

 

  1. Event type, period and venue
    1. The event takes place in the special space delimited for this purpose by the Organizer.
    2. The event consists of activities dedicated to cultural education (music, theater, dance, arts, etc.), other forms of education, artistic interpretation activities (shows), support activities for artistic interpretation (shows) and other recreational and entertaining activities.
    3. The event will take place on the dates and time intervals notified by the Organizer, in accordance with the provisions of these Regulations.
    4. The schedule of events will be announced by the Organizer according to the specific topic.
    5. In the event that the Organizer decides to modify / shorten / extend the duration, duration and / or program of the Event, this fact will be made public in the manner provided for in art. 1.3.

 

 

  1. Participation fee, Access, Participation
    1. Access to the event is based on proof of payment of the participation fee.
    2. The proof of payment on the basis of which the access will be made must be kept for the entire duration of the event.
    3. The payment document is valid for one person only.
    4. Access to the event location is made before the start of the event according to the information provided in advance by the Organizer.
    5. The participation fee can only be paid physically at the Organizer's headquarters.
    6. It is strictly forbidden to publish, in any form, on social networks or other online media the document regarding the payment of the participation fee, as well as its resale. Proof of payment cannot be replaced, and their value cannot be refunded, in case of the Participant's exclusive fault.
    7. The access of minors (0-18 years) to the event location is prohibited.
    8. Is prohibited:
      1. access with weapons or any other objects that can be considered dangerous, white weapons or other objects that can cause a public danger;
      2. access with glass containers, flammable materials, laser pens;
      3. access with animals, except for those accompanying the disabled;
      4. access with alcohol or psychoactive substances;
      5. selling products in the event areas without the organizer's consent;
      6. consumption or sale of prohibited substances;
      7. consumption or sale of alcoholic beverages, other than those sold by the Organizer.
    9. It is STRICTLY FORBIDDEN access and use within the event perimeter without the organizer's authorization for audio-video recording equipment, including but not limited to professional and semi-professional video cameras, including cameras with detachable lenses or mobile phones. The owners of such equipment are obliged to submit to their surrender in temporary custody.
    10. During the event, the Organizer or the Organizer's partners can make audio and video recordings that may contain images and voices of the guests present at the event, as well as of the Participants.
    11. The persons who appear in the footage/photos taken give their consent to the Organizer or partners for the filming/photos, completing and signing the declaration on their own responsibility to accept the use of personal data, including their own image.
    12. The Organizer or the Organizer's partners are obliged to film or take photos only for the purpose of documenting the events carried out by them;
    13. Any photo/video material, taken during the Event, may be used for the purpose of promoting or advertising future events, only with the express consent of the persons captured in these materials, under the terms of the Personal Data Processing Agreement and the self-responsibility declaration , which they will sign.
    14. Also, the location where the Events are held and its perimeter are video-monitored for the purpose of monitoring goods and ensuring the safety of people.

 

 

 

 

 

  1. Rules of conduct within the Events
    1. For the smooth running of the event, people who arrive after it has started will have access to the location only during the scheduled breaks, within the limits of the remaining free seats. After the maximum number of participants is reached, no other person is allowed to enter, regardless of when they arrived.
    2. Participants must avoid conflicts and respect each other.
    3. Nudity and any actions that may be considered offensive or contrary to good morals are not allowed and are not encouraged during the Event.
    4. All participants must comply with social rules, laws and those listed in these Regulations.
    5. All participants are expected to behave respectfully towards others, avoid offensive gestures or actions, and refrain from behavior that may disturb or inconvenience others.
    6. Participants are asked to wear appropriate clothing and maintain an appropriate level of body covering throughout the event.
    7. Harassment, intimidation or physical or verbal abuse of other participants or event staff will not be tolerated and may result in immediate expulsion from the event.
    8. The use of obscene language or inappropriate gestures is strictly prohibited. All participants must express themselves in a civilized manner and avoid any form of verbal or physical violence.
    9. Each participant is responsible for their own actions and behavior and will be subject to legal or disciplinary consequences for failure to comply with these Rules.
    10. Participants are prohibited from engaging in any activities that could endanger or in any way affect the safety or rights of other participants.
    11. Any physical interaction between participants must be based on explicit, clear and unequivocal consent. Each participant must be aware of the other's boundaries and fully respect them. Any pressure or insistence to exceed these limits is unacceptable.
    12. Anyone has the right to withdraw their consent at any point during the physical interaction. If one of the parties feels uncomfortable or wishes to stop the activity, this must be respected without question or pressure.
    13. Consent should be obtained for each stage or progression of physical interaction. Approval for one action does not automatically imply approval for other actions.
    14. The organizer does not assume responsibility for any damage (material or physical) caused by non-compliance with the Regulation and will be able to request compensation from the persons guilty of its violation.
    15. Participants are obliged to respect and not destroy the environment, including constructions and facilities, within the venue of the event.
    16. All Participants are obliged not to carry out any actions that endanger the life or bodily integrity of other people participating in the Event and assume full responsibility for any accidents or any damages that will result from their actions.
    17. The use of drugs or other prohibited substances is illegal and strictly prohibited and will be punished according to applicable laws. Access is prohibited for people who have on them drugs, narcotics, toxic, explosive, flammable, irritant-lacrimogenic materials or substances or other substances/materials considered to be dangerous by the legislation in force, as well as for people who have on them any kind of weapons , ammunition, blunt objects.
    18. Access to the event is prohibited for persons under the influence of alcohol or other psychoactive substances.

 

 

 

  1. Health and safety. Emergency situations
    1. All Participants are obliged to comply with the rules regarding fire and panic protection in units/places accessible to the public (PSI/ISU) and in general to adopt all the necessary sanitary, security, work discipline and generally applicable legislation protection measures .
    2. All Participants are obliged to act to prevent the occurrence of fires or other events, to immediately notify the Organizer and the competent bodies of the imminence or occurrence of such events, and to comply with fire prevention legislation.
    3. All Participants are obliged not to carry out any kind of actions that endanger the life or bodily integrity of the public and assume full responsibility for any accidents or any damages that will result from their actions.

 

 

  1. Penalties
    1. The organizer has the right, with immediate effect, to prohibit the access of a participant to the venue of the event in whole or in part, or to invite the participant to leave the premises, in case of violation of these Regulations or a law in force in Romania, without the participant has the right to a refund of the participation fee.
    2. The participants of the Event agree to comply exactly with these Regulations, their access to the Event being allowed only under the conditions of compliance with the rules included in these Regulations, without limitations or reservations.
    3. Participants may be held liable for direct or indirect damages caused to the location, its owners, the Organizers, its employees, volunteers and collaborators, as well as to other Participants/invited to the Event.
    4. In the situation where, for objective reasons, the Event can no longer be held under the terms of these regulations, the Organizer reserves the right to decide to cancel it, before the date on which the Event was supposed to take place, in compliance with the advertising conditions. In this situation, the Organizer will communicate to the Participants the date on which the Event will be rescheduled, as well as the possibility of using the purchased participation fee or returning the amounts already paid, if the Participant expressly refuses to participate. In any case, the Organizer is not required to pay any amount of money as compensation or damages.
    5. In the situation where, for objective reasons or due to non-compliance with these Regulations by the Participants, in a manner that leads to the impossibility of holding the Event under normal conditions, the Organizer may decide to end it before the established schedule. In this situation, the Organizer cannot be obliged to return the equivalent of the participation fee or to pay sums of money as compensation or the like.
    6. Any disputes arising between the Organizer, on the one hand, and any of the Participants, on the other hand, will be resolved amicably or, if this way is not possible, the disputes will be settled by the competent court from the headquarters of the Organizer. The applicable law is Romanian law.

 

 

 

  1. Force majeure
    1. In cases of force majeure such as war, riot, terrorist attack, demonstrations, economic embargo, accident, fire, natural disaster, earthquake, flood, major short circuit, epidemics, official resolutions or other cases that cannot be foreseen or cannot be controlled by the Organizer or the participant, the Organizer is not obliged to comply with the obligations of these Regulations. The organizer is not responsible for the damages suffered by the participants, if they are the result of a case of force majeure, which can be proven by documents issued by the competent authorities.

 

  1. Processing of personal data
    1. The organizer processes the personal data of participants and companions as follows:
      a) Data categories: name, surname, e-mail address, telephone number; image/audio-video recordings.
      b) The purpose of processing may include: Execution of the contract and fulfillment of obligations in the field of personal data protection - Art. 6 para. (1) lit. b from Regulation no. 679/2016; Media coverage of the event, including for the advertising that will be done for future events; The legitimate interest of the Organizer - Art. 6 para. (1) lit. f from Regulation no. 679/2016.
    2. Event participants understand that personal data consisting of their image and voice may be collected and processed for the purpose of documenting and archiving artistic events. The processing of audio-video recordings and images is carried out in the legitimate interest of the Organizer, taking into account and respecting the rights and freedoms of the persons concerned.
    3. The organizer has the right to use these materials, for the purpose of mediating the event, but also for the publicity that will be done for future events, only with the express consent of the persons captured in these materials, under the terms of the Personal Data Processing Agreement and the declaration on their own responsibility, which they will sign.
    4. After expressing the agreement to process personal data for advertising purposes and signing the declaration on own responsibility, the Organizer has the right to use these materials, including publishing them on various channels (e.g. Facebook, YouTube, etc.), without compensating the participant in any way.
    5. During the events, the Organizer, the associated partners of the Organizer have the right to record and photograph the event. Participants acknowledge that there is the possibility of appearing in such materials, without being able to issue claims on the rights with respect to said materials.
    6. The participants acknowledge that, within the premises of the event, any commercial or advertising activity is prohibited without the written consent of the Organizer.
    7. The data of the participants and companions may be disclosed to partners of the Organizer, sponsors, associated operators of the Organizer, authorized persons, external service providers (e.g.: marketing, accounting), only in accordance with the expression of the will of the participant.
    8. Participants have the following rights related to data protection: access to them, their rectification or deletion or restriction of processing, the right to oppose processing, the right to data portability and the right to lodge a complaint with a supervisory authority (National Supervisory Authority and Protection of Personal Data - ANSPDCP).
    9. The processing of this data will not be done for any purpose other than that stated in these Regulations and expressed by the Participant. The organizer guarantees that it has implemented technical and organizational procedures to protect this data and that the processing will be done legally, according to European Regulation no. 679/2016 and applicable national legislation.

    1. Liability
      1. The organizer is not responsible for the belongings of the participants or for any personal damage caused.
      2. The organizer excludes the assumption of responsibility for damages that occurred in the space of the event, which were not intentionally caused by him.
      3. The Organizer is not responsible for the behavior of the Participants. Each of the participants is responsible for any damage caused to another participant, the Organizer or a third person during the event or in connection with it.
      4. The Organizer's liability for indirect damages is excluded, including significant losses, immaterial damages, lost profits, lost savings and/or damages caused by business interruption.
      5. The organizer is not responsible for actions that take place outside the venue of the event.

     

     

    1. Information
      1. The organizer reserves the right to carry out checks to ensure compliance with these Regulations. Exceptions to these rules are not tolerated, the violation of this Regulation may lead to the evacuation of the person in question from the space of the event and the prohibition of access, without reimbursement of the participation fee.
      2. Persons who violate these Regulations, initiate or participate in events that disturb the order, will be immediately escorted outside the perimeter of the Event, their access will be prohibited to future events, and the Organizer will notify the competent authorities of the state, if necessary.

     

    1. Notifications
      1. The written, express and reasoned request of the Event Participants, in order to notify the Organizer of any irregularities found in the conduct of the Event or any non-compliance with the Regulations, can be submitted to the following e-mail address influxeurope@gmail.com , but no more no later than 17:00 on the first working day after the Event.
      2. Any notification submitted after the above deadline will no longer be considered. In the report, the participants will also fill in the contact data (ie address / email) where the response to the report must be sent.
      3. Complaints will be resolved within a maximum of 30 working days from their submission. The response to the notification will be communicated by the Organizer to the participant, by post or email, to the address indicated in the submitted notification.

     

    1. Conditions for Returning the Participation Fee
      1. The return of the participation fee and the reimbursement of its value is made under the conditions of the existence of an exclusive fault of the Organizer.
